In April 2024, Eron Cannon, with Michelle Garzon and Matt Halldorson, obtained a defense summary judgment in a wrongful death case involving mentally ill patient that rammed his vehicle into a State Trooper and killed him. The Estate claimed that the behavioral health facility who treated the convicted perpetrator had an ongoing duty due to their special relationship with the patient, such that they should have done more to treat him and prevent this intentional act. The Court found that the defendant’s special relationship ended and that there were superseding causes between the end of treatment and the death. Thus, proximate cause was not established.
